Product Liability Directive: software becomes a product
The revised Product Liability Directive applies to products placed on the market from 9 December 2026. Software, including AI and updates, counts as a product, and a manufacturer can be liable for damage caused by a missing security update or a vulnerability. Claimants get easier access to evidence and lighter burdens of proof.
